Terms and Conditions

1. General Provisions

These general terms and conditions of sale apply strictly to all product sales made on the Iberian Peninsula and the Balearic Islands by BODEGAS VALDELANA S.L. (Tax ID No. B01303429) and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. (Tax ID No. B01557008), hereinafter referred to as BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L., to individual consumers.

Any order placed with BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. necessarily implies, as an essential, decisive, and indispensable condition, the Customer’s unreserved acceptance of the General Terms and Conditions of Sale in effect on the date the corresponding order is placed. Furthermore, the Customer acknowledges that acceptance of these terms and conditions shall entail their application to the order to which they refer, as well as to any subsequent order, except in cases where new terms and conditions are brought to the Customer’s attention by BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L.. The fact that BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. do not invoke any of these terms and conditions at any given time shall not be interpreted as, nor shall it constitute, a waiver of the right to invoke them in the future or retroactively.

Governing Law and Jurisdiction: The interpretation and enforcement of these terms and conditions, as well as all actions arising therefrom, shall be governed by Spanish law, unless there are public policy provisions to the contrary.

2. Prices

The prices published by BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. are in euros and are valid except for typographical errors. All prices include the applicable VAT as of the date of the order. Any change in the VAT rate will be automatically applied to the prices of the products for sale. However, these prices do not include shipping costs, which are listed separately and must be accepted by the Customer.

Offers on products for sale at BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. will be displayed on the product page and, unless otherwise indicated, will remain valid as long as they are displayed on the screen.

3. Payment

3.1 Payment Methods

The Customer agrees to pay at the time the order is placed. The initial price listed by BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. for each product offered will be increased by the applicable shipping fees. In any case, these charges will be communicated to the Customer prior to finalizing the purchase.

When placing an order, the Customer may freely choose to pay for their purchases through the REDSYS or PayPal payment platforms. Both options allow payment by debit card and credit card (Visa, Mastercard, Visa Electron, and/or other similar cards).

3.2 Payment Security

BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. employ the highest security measures commercially available in the industry. In addition, the payment process operates on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection so that information is transmitted in encrypted form using 128-bit algorithms, ensuring that it is intelligible only to the Customer’s computer and the Website’s server. Thus, using the SSL protocol guarantees:

3.2.1. That the Customer is providing their data to the server center of BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L., and not to any other entity attempting to impersonate them.
3.2.2. That data is transmitted in encrypted form between the Customer and the server centers of BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L., preventing its potential reading or manipulation by third parties.

4. Product

The offers presented by BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. are valid while supplies last. We reserve the right to modify the product assortment based on stock levels. The photographs, graphics, and descriptions of the products offered for sale are for informational purposes only and do not bind the seller in any way.

Customers are informed that the number of available units is kept up to date based on warehouse inventory and availability from our suppliers. Under no circumstances will more units than are available or than the supplier has reserved be intentionally offered for sale.

Every effort will be made to fulfill all Customers’ product requests. However, on occasion, and due to factors that are difficult to control—such as human error or computer system malfunctions—the quantity ultimately supplied by the supplier may differ from the order placed to fulfill Customer orders.

In the event that a product is unavailable after an order has been placed, the Customer will be notified by email of the total or partial cancellation of the order. The partial cancellation of an order due to unavailability does not entitle the Customer to cancel the entire order. If, as a result of this cancellation, the Customer decides to return the delivered product, they must follow the procedures outlined in the Returns section.

5. Shipping

5.1 Product Delivery

BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. undertake to deliver the product in perfect condition to the address indicated by the Customer on the order form, which must in all cases be located within the Territory.

To ensure optimal delivery, we ask the Customer to provide an address where the order can be delivered during regular business hours. They will not be held responsible for delivery errors if the address provided by the Customer is inaccurate or has been omitted. The Customer is informed that a single order may be split into multiple deliveries.

5.2 Delivery Timeframe

Shipments will be made via a courier service. Your order will be delivered within a maximum of 10 business days from the date the order is confirmed. Although delivery typically takes between 3 and 6 days after the order is placed, these timeframes are estimates and may vary due to logistical reasons or force majeure. In the event of delivery delays, customers will be notified as soon as we become aware of them.

Each delivery shall be deemed to have been made as soon as the carrier makes the product available to the Customer, according to the tracking system used by the shipping company. In the event of delays attributable to BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L., the Customer may cancel their order in accordance with the procedure described in section “6. Returns.” Delays shall not be considered to have occurred in cases where the order, although made available to the Customer within the agreed timeframe, could not be delivered for reasons attributable to the Customer.

5.3 Delivery Information, Undelivered Orders, and Lost Packages

If the Customer is absent at the time of delivery, the carrier will leave a notice indicating how to arrange a new delivery. As part of the courier service, tracking measures are implemented to ensure that the delivery is completed.

If, 7 business days after the order is dispatched, a delivery has not been arranged, the Customer must contact us. If the Customer fails to do so, 10 business days after the order was dispatched, the order will be returned to our warehouses, and the Customer will be responsible for the shipping and return costs, as well as any associated handling fees.

If the reason for non-delivery is that the package has been lost, the carrier will launch an investigation. In such cases, response times typically range from one to three weeks.

5.4 Delivery Procedures

The Customer must verify that the package is in good condition in the presence of the carrier who, on behalf of BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L., is delivering the product. Any damage to the packaging must be noted on the delivery receipt. If any issues are subsequently detected (dents, breakage, signs that the package has been opened, or any damage caused during shipping), the Customer agrees to report them via email within 24 hours of delivery. After this period has elapsed, incidents of this type will not be addressed (except in cases involving items under warranty).

6. Return and Cancellation Policies

6.1 Returning Merchandise

In accordance with current regulations, you have the right to return any item purchased from BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. within 7 days of the date of receipt. No explanation is required; any item returned in its original, sealed packaging and in perfect condition will be accepted without further ado.

They undertake to issue a refund within a maximum of 15 days from receipt of the return. Before making a return, the Customer must notify the Customer Service department.

If the return is due to a defective item or an item that does not match the order, BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. will cover the costs of the return and a new shipment. If the return is due to the Customer’s dissatisfaction with the order, the purchase price will be refunded, excluding shipping and return costs.

6.2 Order Cancellation

If the order is canceled before the merchandise is shipped, the Customer will not incur any charges. If the order is canceled after it has been shipped, the Customer must cover the corresponding shipping and return costs.

7. Privacy Policies

Customers and Users agree to browse the website and use its content in good faith.

In compliance with the provisions of Organic Law 15/1999 on the Protection of Personal Data, please be advised that filling out any form on www.bodegasvaldelana.com or sending an email to any of our email addresses implies acceptance of this privacy policy, as well as authorization for BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. to process the personal data provided, which will be incorporated into the database owned by said companies, registered with the General Registry of the Spanish Data Protection Agency.

Customer data will be used to send commercial communications regarding completed sales and for the delivery of products. Simply by visiting the website, Users do not provide any personal information nor are they obligated to do so.

We guarantee the utmost discretion and confidentiality regarding the information provided, using it solely for the purposes indicated. It is presumed that the data has been entered by the data subject or by an authorized person and is correct and accurate.

The Customer is responsible for the accuracy of their data, and BODEGAS VALDELANA S.L. and BODEGAS Y VIÑEDOS LADRON DE GUEVARA S.L. are not liable for any inaccuracies. In accordance with current data protection laws, appropriate security measures have been implemented to prevent the loss, misuse, alteration, unauthorized access, or disclosure of the information.
